AI Voice Agent Compliance & TCPA Notice

ePoint AI provides artificial intelligence voice agent technology as a platform service only. The platform enables automated outbound and inbound voice communication on behalf of our clients.

IMPORTANT LEGAL NOTICE FOR ALL USERS:

Clients are solely and exclusively responsible for:

  1. Obtaining all legally required prior express written consent from call recipients before initiating any outbound AI voice, SMS, or automated communication;
  2. Full compliance with the Telephone Consumer Protection Act (TCPA), 47 U.S.C. 227, and all FCC regulations, including the FCC's 2024 ruling classifying AI-generated voice calls under TCPA provisions;
  3. Compliance with all applicable federal, state, and local telemarketing laws, including but not limited to the FTC's Telemarketing Sales Rule (TSR), state do-not-call regulations, and the National Do Not Call Registry requirements;
  4. Ensuring that all AI-generated voice communications are clearly identified as automated/AI-generated where required by law.

ePoint AI does not provide legal advice. Clients should consult qualified legal counsel regarding their specific calling compliance obligations before deploying any voice agent.

Use of the ePoint AI platform to make unconsented outbound calls, to circumvent do-not-call lists, or to violate any applicable telemarketing law constitutes a material breach of these Terms and will result in immediate account termination.

ePoint AI reserves the right to suspend or terminate any account suspected of TCPA or FCC violations without prior notice.

Permitted Uses

  • Customer support and appointment scheduling for your business
  • Invoice reminders and payment follow-ups you are legally authorized to send
  • Lead nurturing and sales outreach with proper consent
  • Internal business automation and CRM synchronization
  • Multilingual customer communication where permitted by law
  • API integration for your own applications within plan limits

Prohibited Uses

  • Spam, robocalls, or unsolicited bulk messaging without consent
  • Illegal content or activities in any jurisdiction
  • Deepfakes, impersonation, or deceptive synthetic media
  • Weapons, explosives, or instructions for harmful activities
  • Fraud, phishing, or identity theft
  • Hate speech, harassment, or incitement to violence
  • Unauthorized resale or white-labeling of the platform

AI-Specific Prohibitions

You may not use AI outputs to deceive, manipulate, impersonate individuals without consent, or cause harm to third parties. Human review is required for high-stakes decisions in regulated industries.

Results generated by ePoint AI do not constitute professional legal, medical, or financial advice. Always consult a licensed professional before making decisions based on AI outputs.

Enforcement

ePoint AI reserves the right to suspend or terminate accounts that violate this policy immediately and without prior notice.
